1. Scope
These conditions apply to offers, orders, sales and agreements with consumers and professional customers, unless otherwise agreed in writing. Mandatory consumer law takes precedence wherever applicable.
2. Products and Product Information
Tiny-FX develops and sells miniature lighting, electronic components, effect modules, accessories and custom electronic solutions. Product photos and specifications are prepared with care. Minor variations may occur; photos and screen settings may affect displayed colours and light colours. Technical measurements are indicative where stated.
3. Prices
Prices are in euro. Consumer prices include applicable VAT unless clearly stated otherwise. Shipping and additional costs are communicated before order confirmation. Custom engineering may be priced by quotation.
4. Orders and Formation of the Agreement
An order becomes final when Tiny-FX confirms it. An automatic acknowledgement of an inquiry does not necessarily mean acceptance. Tiny-FX may refuse an order if products are unavailable, there is an obvious pricing or system error, or we cannot fulfil the order. Payments already received for goods that will not be delivered are refunded where applicable.
5. Payment
Payment is currently by bank transfer. Payment details appear on the order confirmation or invoice. Tiny-FX may request full or partial advance payment for custom work, special production or engineering; this is communicated before confirmation.
6. Delivery
Orders are shipped from Aalst, Belgium. Carriers may include bpost, GLS or UPS. Shipping costs are communicated before order confirmation. Production or lead times are separate from transport times. Delivery times are indicative unless expressly agreed otherwise; mandatory consumer delivery rights remain unaffected.
7. Made-to-Order Products
Some standard products are assembled or soldered only after we receive an order. This alone does not exclude them from the consumer right of withdrawal.
8. Personalized and Custom Products
Goods genuinely manufactured to customer specifications or clearly personalised may be excluded from the right of withdrawal where legally applicable. Any applicable exclusion is communicated before the order is placed.
9. Consumer Right of Withdrawal
For distance purchases where the legal right applies, consumers may withdraw without giving a reason within 14 days. For goods, this period generally begins the day after you, or a third party you designate other than the carrier, receive the goods. For goods ordered together but delivered separately, it generally begins after receipt of the last item.
Notify Tiny-FX before the period expires by an unambiguous statement, for example by email to hello@tiny-fx.com or by post to the address above. You may use the model withdrawal form, but this is not required.
Withdrawal form10. Returns Following Withdrawal
Send or hand back the goods to the address above within 14 days after notifying us of withdrawal. You bear the direct return shipping costs unless Tiny-FX states otherwise. You may be responsible for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
We reimburse payments, including standard outbound delivery costs, within 14 days after being informed of withdrawal. Extra costs for a more expensive delivery option you selected are not reimbursed. We may withhold reimbursement until we receive the goods or evidence that you sent them back, whichever is earlier. We use the original payment method unless another method is expressly agreed, without reimbursement fees. Mandatory legal rights remain unaffected.
11. Warranty and Conformity
Consumers benefit from the statutory conformity guarantee. For new goods, this generally covers lack of conformity that becomes apparent within two years of delivery. Legal remedies may include repair, replacement, a price reduction or termination under the applicable conditions.
Damage caused by misuse, incorrect wiring, operation outside specified limits, unauthorised modifications or normal wear is not covered as a product defect. This does not remove statutory rights for an unrelated lack of conformity. Products may contain small or sensitive electronic components.
12. Complaints and Defective Products
Contact hello@tiny-fx.com with your order number, item or SKU and a description of the issue. Photos may help. Please discuss a defective return with Tiny-FX before sending it where possible, so we can arrange an appropriate solution. This is not a condition for exercising mandatory consumer rights.
13. Installation and Use
Customers are responsible for correct installation and use. Respect the stated electrical, thermal and mechanical limits and follow polarity, power supply and safety instructions. This does not limit Tiny-FX’s statutory responsibility for product conformity or instructions.
14. Intellectual Property
Designs, text, photos, drawings, PCB designs, firmware, software and documentation remain protected by the rights of Tiny-FX or the relevant rights holders where applicable. Buying a product does not transfer intellectual property rights. Custom engineering does not automatically transfer source, design or production rights unless separately agreed in writing.
15. Liability
To the extent legally permitted, Tiny-FX is not liable for indirect damage or damage caused by misuse, incorrect installation or operation outside specifications. Nothing in these terms excludes or restricts liability that cannot legally be excluded or restricted, or mandatory consumer rights.
16. Force Majeure
Events beyond our reasonable control may temporarily prevent performance. We will inform you of the impact and seek a reasonable solution. Affected obligations may be suspended for the event’s duration, subject to applicable law. This does not remove mandatory rights to end the agreement or receive reimbursement.
17. Applicable Law
Belgian law applies, without prejudice to mandatory consumer protections, including those of your country of habitual residence where applicable. Disputes fall within the jurisdiction of the competent courts determined by applicable law.
